Lawyer warns of criminal liability under Article 217 after PM’s ouster

Haitian lawyer Samuel Madistin said on Monday that the removal of Prime Minister Alix Didier Fils-Aimé by Haiti’s Transitional Presidential Council (CPT) carries immediate legal consequences and must be enforced without ambiguity.

Speaking to local media, Madistin warned that any attempt by the ousted prime minister to continue exercising government authority could amount to a criminal offense, rather than a mere political or administrative dispute.

He cited Article 217 of Haiti’s Penal Code, which criminalizes the usurpation of office, including the act of assuming or maintaining powers that have been legally withdrawn.

The CPT voted to revoke Fils-Aimé by a majority of five out of seven members, a threshold that Madistin said was sufficient to give the decision full legal effect.

The statement comes amid growing institutional uncertainty in Haiti, where disputes over the scope and legitimacy of transitional authority continue to deepen political instability.
