Le Premier Ministre de facto, les signataires de l’Accord Tonton Noël du 21 décembre et le Haut Conseil de Transition se joindront-ils à ce mouvement qui a le mérite d’identifier certains responsables des crimes, assassinats qui endeuillent les familles en Haïti, en facilitant les achats et le transport d’armes et de munitions vers des pays comme le Mexique, Haïti, la Jamaïque, Antigua… etc. ?
Le procureur général de Californie, Rob Bonta, s’est joint à un groupe de procureurs généraux des États-Unis pour déposer un mémoire d’amicus soutenant le gouvernement mexicain dans un procès américain.
Le gouvernement mexicain poursuit les fabricants d’armes à feu, les blâmant pour la violence armée au Mexique.
Les procureurs généraux ont déposé leur mémoire devant la Cour d’appel du premier circuit dans Estados Unidos Mexicanos c. Smith & Wesson Brands, Inc.
Les procureurs généraux veulent voir la décision du tribunal de district qui a rejeté la poursuite annulée. Ils soutiennent que la loi fédérale sur la protection du commerce légal des armes (PLCAA) « ne protège pas les entreprises, notamment Smith & Wesson, Beretta, Ruger, Glock, Century Arms, Barrett et Colt ; ainsi que le distributeur d’armes Interstate Arms, de la responsabilité », selon un communiqué de presse du bureau du procureur général de Californie, Rob Bonta.
« Les fabricants et les vendeurs d’armes semblent croire que la PLCAA leur donne un laissez-passer gratuit pour fabriquer et distribuer des armes dont ils savent qu’elles font l’objet d’un trafic et sont utilisées pour terroriser les communautés au Mexique », a déclaré le procureur général Bonta dans le communiqué. « Dans la plupart des industries, les entreprises sont bien conscientes qu’elles peuvent être tenues responsables lorsqu’elles enfreignent la loi – les armes à feu ne devraient pas être différentes. Nous exhortons le tribunal à annuler la décision du tribunal de district et à permettre à cette affaire d’aller de l’avant.
On estime que 70% des armes à feu récupérées au Mexique de 2018 à 2020 provenaient des États-Unis, selon un rapport de 2020 du U.S. Government Accountability Office.
Le bureau de Bonta note que le Mexique n’a qu’un seul magasin d’armes à feu et qu’environ 200 000 armes à feu arrivent au Mexique via les États-Unis chaque année.
La PLCAA permet à la loi de tenir les fabricants et les vendeurs d’armes à feu responsables de faute lorsqu’ils violent sciemment la loi.
Le gouvernement mexicain allègue dans son procès que huit fabricants d’armes à feu et un distributeur savent que leurs armes font l’objet d’un trafic illégal vers le Mexique et qu’ils enfreignent sciemment la loi pour vendre et commercialiser ces armes.
Le tribunal de district américain du district du Massachusetts a rejeté la demande du Mexique en novembre 2022, arguant que les demandes de common law étaient interdites par la PLCAA. Il a également déclaré que le Mexique « n’avait pas allégué de manière plausible les réclamations légales », selon le communiqué du bureau de Bonta.
En réponse, le Mexique a fait appel de sa cause devant le premier circuit.
Dans le mémoire d’amicus, les procureurs généraux ont dit au tribunal de réserver la décision du tribunal de district, arguant que la PLCAA ne protège pas l’industrie des armes à feu de toute responsabilité dans « leur rôle dans l’alimentation de la violence armée endémique au Mexique », selon le communiqué.
« L’interprétation de la PLCAA par le tribunal de district empiète sur l’autorité des États en limitant la capacité des États à créer des recours pour une conduite qui cause un préjudice à leurs résidents », a écrit le bureau de Bonta dans le communiqué. «Le Congrès n’avait pas l’intention d’empêcher les actions contre les membres de l’industrie des armes à feu pour leur propre faute; et l' »exemption préalable » de la PLCAA permet des actions civiles contre un défendeur de l’industrie des armes à feu qui a sciemment violé une loi applicable à la vente ou à la commercialisation d’une arme à feu ou d’un autre produit qualifié.
